Terms of Service for Zombie Trend AI

Welcome to Zombie Trend AI ("Zombie Trend AI", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of zombietrend.app and the services that let you generate short videos from your photos using artificial intelligence (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Account

• You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Service.
• Certain features may require creating an account. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity under your account.
• We may suspend or terminate accounts that violate these Terms.

2. Description of the Service

Zombie Trend AI generates short, fictional, AI-made videos in the style of the "AI zombie trend" from two photos you upload. Results vary and depend on your photos and the limits of AI technology; faces may not always look exactly like the people in your photos. Zombie Trend AI is an independent service and is not affiliated with TikTok, CapCut or any app that hosts the original trend template.

3. Acceptable Use

You agree not to:

• Use the Service to create or share content that is illegal, hateful, violent, sexually exploitative, or otherwise harmful.
• Infringe or misappropriate the intellectual property, privacy, or other rights of any person.
• Attempt to bypass usage limits, scrape or copy the Service, or reverse engineer our models or systems.
• Use outputs to train, fine‑tune, or evaluate your own or third‑party AI models.
• Interfere with Service operation, security, or other users.

We may remove content or restrict access where we reasonably believe these Terms or applicable laws are violated.

4. Photos of People and Consent

• Only upload photos of yourself, your own pets, or adults who have given you permission to use their photos for this purpose.
• Do not upload photos of children or minors, celebrities or other public figures, or anyone who has not agreed to appear.
• Do not use the Service to harass, deceive, impersonate or embarrass anyone, or to create content that could be mistaken for real footage of a real event.
• Generated videos are AI-made fiction. Do not present them as real, and label them as AI-generated where a platform requires it.
• You are responsible for the photos you upload and how you use the results. We may remove content and suspend accounts that break these rules.

5. Generated Content and Ownership

• You own the videos you generate using the Service, subject to these Terms and any applicable third‑party rights. You are responsible for ensuring your use of generated content does not violate any law or third‑party rights.
• We retain all right, title, and interest in and to the Service, including AI models, software, and underlying technologies. No rights are granted except as expressly stated.
• License to us: You grant us a worldwide, non‑exclusive, royalty‑free license to host, process and transmit your photos and generated videos solely to operate the Service, including sending them to our AI video generation provider. We do not publish your videos or use them in marketing without your separate permission.

6. Credits and Payments

• Videos are paid for with credits from one‑time credit packs. There are no subscriptions or automatic renewals. The credit cost of each video is shown before you create it.
• If a video fails to generate, its credits are returned to your balance automatically.
• Payments are processed by third‑party providers. You authorize us and our payment processors to charge your selected payment method for all fees.
• Except as required by law or stated in our Refund Policy, fees are non‑refundable.
• We may change pricing or limits at any time with advance notice posted in the Service. Continued use after changes take effect constitutes acceptance.

7. Promotions

We may offer free credits or promotions with specific conditions. We may change or end them at any time.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and share information. Please review it carefully before using the Service.

9. Third‑Party Services

The Service may integrate third‑party tools (e.g., payment processors, analytics, content delivery). We are not responsible for third‑party services, and your use may be subject to their terms and policies.

10. DMCA and Intellectual Property Complaints

If you believe content created through the Service uses your image without permission or infringes your rights, contact us at the merchant contact listed on your payment receipt with details. We will review and take appropriate action in accordance with applicable law.

11. Disclaimers

THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT OUTPUTS WILL MEET YOUR EXPECTATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Zombie Trend AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Zombie Trend AI and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your generated content; (c) your violation of these Terms; or (d) your violation of any law or third‑party rights.

14. Termination

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms or law, or to protect the Service or other users. You may stop using the Service at any time. Sections that by nature should survive termination (including ownership, disclaimers, limits of liability, indemnification, and governing law) will survive.

15. Changes to the Service and Terms

We may modify or discontinue any part of the Service at any time. We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., by posting an update in the Service or updating the “Last updated” date). Your continued use after changes take effect constitutes acceptance.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
